A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to answer human smuggling allegations, he was detained in immigration detention.

In her order, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
